LORI BRADDOCK,

What Is a Fiduciary?

A Fiduciary is an individual who assumes responsibility for managing the financial and personal affairs of a client for their exclusive benefit. The Fiduciary is entrusted by the client to manage their affairs in a manner that considers their preferences and objectives. In Arizona, a Fiduciary providing services for a fee must be licensed by the Arizona Supreme Court and abide by state law. Becoming a licensed Fiduciary requires meeting specific eligibility criteria, completing training, passing a test, providing a bond, undergoing fingerprinting, and passing credit and criminal background checks. A Licensed Fiduciary must attend continuing education classes and renew their license every two years. A Fiduciary may hold various positions, serving by court appointment or under a contractual agreement. Estate planning documents may also name a Fiduciary to provide future service in case the client is no longer capable of managing their affairs or passes away. In cases of court-appointed Fiduciaries, the Fiduciary may be required to post a bond and report yearly to the court regarding the administration of the client’s affairs. The fees charged by the Fiduciary are subject to court approval. A Fiduciary may also be appointed to manage the estate of a deceased person or serve as a trustee of a trust, whereby they identify, inventory, and protect assets, pay bills and claims, determine beneficiaries, pay administrative expenses, prepare tax returns, and distribute assets in accordance with the terms of the will, trust, or state law. As more retirees move to Arizona, many services have emerged to help meet their specific needs.
